The Court of Appeal, Abuja Judicial Division, has dismissed an application filed by the Adekunle Omoaje faction of the Action Alliance (AA), reaffirming Chief Barr. Kenneth Udeze as the recognised National Chairman of the party.

According to an official statement signed by the National Secretary of the Action Alliance, Vernimbe A. James, the application challenged the authority of Chief Barr. Kenneth Udeze to engage legal counsel on behalf of the party in Appeal No. CA/ABJ/CV/854/2026: ADC vs Incorporated Trustees of Former Legislators & Ors, a case concerning the deregistration of five political parties.

The statement said the application questioned the competence of Barr. Madeh Yakubu, Esq., who was briefed by Chief Barr. Kenneth Udeze to represent the Action Alliance in the appeal.

In its ruling, the Court of Appeal dismissed the application, describing it as an abuse of court process.

The court held that Adekunle Omoaje already has a pending appeal before the Supreme Court challenging the earlier Court of Appeal judgment which recognised Chief Barr. Kenneth Udeze as the authentic National Chairman of the Action Alliance.

The appellate court also awarded ₦500,000 in costs against Adekunle Omoaje in favour of Chief Barr. Kenneth Udeze.

According to the statement, the ruling reaffirmed that the Court of Appeal’s earlier judgment recognising Chief Barr. Kenneth Udeze as the National Chairman of the Action Alliance remains valid, subsisting and binding pending the determination of the appeal before the Supreme Court.
